Personal data are all information about an identified or identifiable natural person; identifiable natural person means a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as name, identification number, location data, network identifier or one or more factors specific to physical, physiological, genetic, mental, economic, cultural or social the identity of that individual.

  4. The administrator has not appointed a privacy officer.

Sources and categories of processed personal data

 

  1. The administrator processes the personal information you provided to him or the personal information that the administrator obtained as a result of your order:

    • first and last name

    • email address

    • postal address

    • telephone

  2. The Administrator processes your identification and contact information and the data necessary to perform the contract.

Legal reason and purpose of processing personal data

 

  1. The legal reason for the processing of personal data is

    • compliance with the legal obligation of the trustee under Article 6 (1); 1, par. (c) GDPR;

    • the legitimate interest of the controller in the provision of direct marketing (in particular for sending business notices and newsletters) pursuant to Article 6 (1); 1, par. (f) GDPR;

    • Your consent to processing for the purpose of providing direct marketing (in particular for sending business notices and newsletters) pursuant to Article 6 (1). 1, par. a) GDPR in conjunction with § 7 para. 2 of Act No. 480/2004 Coll., On certain information society services in the event that the goods or services were not ordered.

  2. The purpose of the processing of personal data is:

    • handling your order and exercising your rights and obligations under the contractual relationship between you and the administrator; the order requires personal data necessary for successful order processing (name and address, contact), the provision of personal data is a necessary requirement for the conclusion and performance of the contract, without the provision of personal data it is not possible to conclude the contract or

    • fulfillment of legal obligations towards the state,

    • sending business announcements and doing other marketing activities.

  3. An automatic individual decision-making within the meaning of Article 22 of the GDPR shall be made by the administrator. You have given your explicit consent to such processing.

Data retention period

 

  1. The administrator keeps personal data

    • for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the trustee and to assert claims arising from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).

    • for a period of 10 years if consent to the processing of personal data for marketing purposes is withdrawn, if the personal data are processed by consent.

  2. After the personal data retention period expires, the controller deletes the personal data.

Personal recipients (subcontractors of the administrator)

  1. The recipients of personal data are persons

    • involved in the delivery of goods making payments under contract,

    • providing the services of running an e-shop (Oriental Foods) and other services related to the operation of the e-shop,

    • providing marketing services.

  2. The controller does not intend to transfer personal data to a third country (outside the EU) or to an international organization. The recipients of personal data in third countries are mailing / cloud service providers.

  1. The processing of personal data is carried out by the controller, but personal data may also be processed for him by the following processors:

    • Ascend by Wix service provider

    • Wix

    • or another provider of software and services software that is not currently used by the administrator.

Your rights

 

  1. Under the conditions set out in GDPR you have

    • the right of access to his personal data under Article 15 of the GDPR,

    • the right to rectify personal data pursuant to Article 16 of the GDPR, or to restrict processing under Article 18 of the GDPR,

    • the right to delete personal data pursuant to Article 17 of the GDPR,

    • the right to object to processing under Article 21 of the GDPR,

    • the right to data portability under Article 20 of the GDPR; and

    • the right to revoke the processing consent in writing or electronically to the administrator's address or e-mail address specified in Article III of these Terms and Conditions.

  2. You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to privacy has been violated or to go to court.

Conditions for securing personal data

 

  1. The Administrator declares that he has taken all reasonable technical and organizational measures to secure personal data.

  2. The administrator has taken technical measures to ensure data and personal data storage in paper form, especially passwords, antivirus, encryption, backups, etc.

  3. The Administrator declares that only the person authorized by him / her has access to personal data.

VIII.
Final provisions

 

  1. By submitting an order from the online order form and with the privacy terms, you confirm that you accept them in their entirety.

  2. The Administrator is entitled to change these conditions. It will publish the new version of the Privacy Policy on its website and at the same time send you a new version of these terms to your email address, which you provided to the administrator.

These conditions come into effect on 1.4.2020.
